By 1941, eight of the nine Justices were Roosevelt appointees. Harlan Fiske Stone was elevated to Chief Justice from the position of Associate Justice by Roosevelt.

Roosevelt's appointees would not share ideologies, and some, like Hugo Black and Felix Frankfurter, would become "lifelong adversaries."[166] Frankfurter even labeled his more liberal colleagues Rutledge, Murphy, Black, and Douglas as part of an "Axis" of opposition
